just one very small problem with you arguement
CHM gained nothing from these transactions
MMX gained significantly
CHM whole arguement is that Barnes and Grimaldi (acting as a defacto officer of CHM) used their position in CHM for their benefit and for the benefit of a third party that is MMX.
MMX benefit was that it was able to make the critical cash payments to secure the project. CHM contend that without this MMX would have no project.
The whole arguement about if CHM had knowledge is a nonsense. New management of CHM are saying that old CHM management ripped the company off and this was done in conjection with MMX for MMX benefit.
