I agree with what you are saying - ARB suspension (Old Man Emu) does not modify suspension. It merely upgrades it. So any talk of ARB suspension having issues with ADR compliance is not justified.
A minimal height change (50mm maximum over standard) is normal. ESC has been on 4x4s for a number of years and ARB has continued to sell (and develop) new suspension for newly released 4x4s. See the new BP-51 shock absorber that they released last year - a world class product that was designed, tested and launched by ARB. Also, here is a clip from YouTube of ARB's stability control testing.
