However, The first outcome I am wanting to hear is from the current negotiations taking place in the DRC. This will have a significant bearing on the Ownership disputes, the award of the ML and whether any of the Court cases proceed.
AVZ will be holding to affirm its legal rights to a 75% interest in Dathcom and our pre-emptive rights of the 25% interest held by Comminere in the Damono project. If no agreeable outcome comes from these negotiations in AVZ’s favour, and soon, we will most certainly be off to the ICC in Paris. This is not where any of the Parties want to be going, rest assured for Dathcom or Comminere.
The strength of AVZ’s position in these negotiations is the findings from the DRC independent IGF report on the mismanagement of DRC mining assets by Comminere.
The President will be forced to act on the IGF REPORT if his own Ministry doesn’t get this sorted for the interests of the DRC. The outcomes will be critical to the DRC and future investment from major countries around the world and whether large companies will want to do business in the DRC. This also has major ramifications for the image of the President and his dealings with world leaders.
Time is fast running out for both Dathcom and Comminere. The President will undoubtedly be well informed as to how the negotiations are proceeding and which players are holding out based on the illegal transactions to which they rely on. It is a good sign of his leadership in that he is giving his Ministry every chance to resolve this mess or else he will intervene and clean it up based on the recommendations in the IGF Report.
IMO the Outcomes from the negotiations over the next few weeks will be critical to determining whether the ICC cases proceed or are withdrawn. This will have significant impact to the TIMING of the award of the ML.
