ATO has much bigger fish to fry than JAT actually ever paying any tax. ASIC probably keeping a closer eye on them, and will just add them to the pile.
Court case is a distraction of the real issue. Selling their own brand, at a profit. Appears someone is propping up the price. Holders have brave hands.
