No clue at all what sort of agreement is in place, but I think we can be sure that they precision would have pushed something like this. They would be remiss not to protect their own path of advancement to the fullest extent possible. Without seeing the agreement (which we never will) we are unlikely to know without confirmation from the (either) company.
