look, the other guy you talking to gave all sort claims including no loss of rent and price already accounted for current situation at a time when share was trading at $1 and also said that rent will be paid first and again s/he was wrong when healthscope didn't pay full rent this month beginning.
The fight between healthscope and HCW will not be easy neither be short lived in my opinion ! See, if you have tenant in residential or commercial property then you send notice to the tenant that is not just using your property but also occupies it with their family or their business equipment. In case of healthscope they are occupied by third party i.e. patients ! So no court in the world will rush through it not just on humanitarian ground but also on logic ground that they won't be setting up an example where they ask 100's of patient to move out in 20 days !!!
the moment HCW goes to court the legal bill starts ... ! Now, new buyer may not want to put their hands up for loss making facilities and i assume healthscope has to provide all accounts to all buyers in sell process and we don't know whether HCW sites are profit making or loss making ! out of this due diligence decides if someone buys HCW & their unlisted fund hospital or not.
it is complex legal matter so no matter what anyone (including myself) says here the final outcome will be difficult to predict. obviously if brookfield get a Chinese buyer paying 70c for every $1 then they might sell and walk away !
if Albo can maintain his previous stand that they won't bailout private operators then best you get from government is ability to take existing patient to government hospitals. remember, day patients are not the issue neither are pre-booked patients so issue are those going through longer treatment and admitted to hospital for long-stay.. !
While operator trying their best to make this issue around election, they didn't realise that if Government says we pay brookfield then there will be massive resistance from the people who normally wait in queue for hours to get small check-up at hospital because our public hospitals are not well funded so how come Albo ready to pay wealthy who normally go for private health insurance !!! So it is not easy for Government to bailout and that may be the case why they rejected this last year.
