I guess you missed the whole question.
The Supreme Court of a country does not listen to every single case brought to them: they are besieged by all kinds of cases and need to pick and choose which ones to spend their limited time on. BRL/L&M is a civil commercial case, with no constitutional implication whatsoever. Perhaps you want to think a second before posting High School level explanations.
For example, the US Supreme Court gets 7000 cases sent to them each year...and they hear a grand total of 80. Now NZ SC obviously has far less requests...but the main point remains: limited time means few cases will be heard by the NZSC.
