My first question is: what is your source for this?  My understanding (memory fading now) was that the Court of Appeal was the last hope.

Well if the case will go on for years...then there is no reason whatsoever for BRL to avoid paying a dividend AND stepping up the pace of the buyback.  In fact, the case for an aggressive build up of cash reduces considerably.  What is the point of raising the cash when they already have a 10 month alert already...and if the case goes to the Supreme Court...then another many months to go.
