Completely different aboriginal claimant group, thats the difference. TAR have to work with the Adnyamathanha Traditional Lands Association, who are in receivership and will be spending years in court fighting each other. This is why TAR have sidestepped the typical SA Native Title heritage process and gone directly to the relevant state minister with:
The Aboriginal Affairs and Reconciliation (AAR) unit of the South Australian Department of Premier and Cabinet today published the Consultation Information Package (CIP) for an application by Strikeline Resources Pty Ltd (Strikeline) for Section 23 and 21 authorisations under the Aboriginal Heritage Act 1988 (SA) (authorisations).
The public consultation period will end on 30 September 2021, and the State Aboriginal Heritage Committee will then consider responses. The application for authorisation will ultimately be considered by the Premier as Minister for Indigenous Affairs, responsible for the Aboriginal Heritage Act.
This is not the normal path for exploration in SA, usually quicker to get cultural heritage approval from the existing recognized claimants, but as ATLA are in administration, there is no-one to deal with regarding cultural heritage clearances. So this step goes to the AAR unit of the SA Dept Premier & Cabinet and with consultations ending in late Sept and then public servants going on holiday for Xmas and New Year and then a state election in March 2022 they might have the authorization to drill by mid-2022..... and that's assuming that one of the disgruntled litigants don't try to get an injunction to appeal any recommendations of the State Aboriginal Heritage Committee.
That process will still be quicker than waiting for all the competing claimants of ATLA to exhaust all their options in the court system, that's going to be a lawyers picnic and will be keeping Adelaide lawyers in BMW's for the next few years, all courtesy of the taxpayer.
