    BTU won a declaration from the environment court earlier this year that an amendment to the Resource Management Act RMA in 2004 excludes climate change consideration from all coal mining applications under the RMA.
    Surely that amendment would have to be repealed for the WCEN & RFBPS to have a successful appeal.
    The real issue is the environment one concerning the escarpment.
