Don't know which part of "The MOU is non-binding & does not contain definitive terms, and as such, is incomplete in the absence of a definitive agreement." in the initial NAB announcement (1 March 2017) you took to mean binding.
This was never touted by the Company as a binding agreement - however they did overstate the significance a bit in their initial TH request when they called it a "material commercial agreement".
The cost of the agreement is immaterial and has been discussed to death previously.
