The DRC has shown good intentions for getting to the origin of this dispute and the individuals that have transacted to undermine their Mining Code and delay the award of the Mining Licence. It is well documented who the people are within the DRC that has allowed this to occur but iMO there is a coverup happening to protect certain individuals within the DRC Ministry from being held accountable by the President.

As we know the IGF conducted the internal review on behalf of the DRC Govt. and their findings have been well published in previous announcements. With two companies now going head to head before the ICC the DRC is open to have this dispute play out before an independent Tribunal so the Lawyers can deep dive further to obtain critical details how the purported 15% sale was transacted and name the people that have been most active in breaking the DRC Mining code.

You would be a fool to think the IGF report would not have been tabled during the hearing. More specifically the Agreements and transactions which AVZ had made to confirm the rights it had purchased would have been presented for Jin Cheng lawyers to review.

It is my belief that corrupt individuals within Cominiere and Dathcom have sought to change the rules of the game in open discussions with AVZ post the release of the DFS in order to obtain a bigger percentage and more revenue. When their actions have failed to change AVZ’s stance both these parties have sought to undermine AVZ's quest to obtain the Mining Licence by illegally transacting with Jin Cheng Mining company and have obtained a financial advantage through this deceptive process.

With the hearing having concluded Jin Cheng’s lawyers will undoubtedly be reviewing AVZ’s transcripts and copies of legal documents. IMO Jin Cheng will have to withdraw from the challenge.
They will come to an Agreement that the actions of Cominiere were illegal and that the promises made that they could make this work in favour of Jin Cheng were spurious and false. The DRC Govt. has been right to not intervene or be seen to throw its support behind either side in the challenge.

By allowing the independent ICC Arbitration process to run its process and consider the submissions from both groups of Lawyers I am confident the ICC will achieve a ruling in favour of AVZ. This decision will be duly enforced by the DRC Govt. and be seen as conforming to International Law.
