Risk Management would surely kick in to say having the workforce in the direct floodzone for any high-risk tailings dam is not acceptable. I dont know if BHP were involved in designing or planning the failed dam but regulators and the company will surely be in the firing line. Earthquake or no earthquake someone has either failed to maintain or failed to design or failed to plan. I have jumped out for now. Even if investigation clears BHP the short term information vacuum will hurt their reputation. If it turns out they are liable then its a big hit.
