While I agree that there is no legal basis to wiggle out of the T2 commitment (and why the original pricing was so generous), the reality is you can't go around and burn all your investors if you have any plans to raise again - the Australian market is just too small. Some compromise will be reached.
The company will get the money, but there will be some extra dilution.
