I would assume with question number 4, we were told this because it was the original plan. If they had known it wasnt true, and still told us, thats a breach without any doubt.
However if the information was correct, then their fault would be not updating us as soon they found out about the third party, which they can claim isnt a price sensitive announcement anyways because their tools wouldnt have arrived until April anyway, so technically the drill being used by a third party isnt delaying anything.
