page 53: APRA did an internal legal assessment in likelihood of success in pursuing questor matter. legal advice came back that it was complex and less than clear cut.
page 56 APRA acknowledges whilst TPS was disadvantaged its members were not directly disadvanted as members were compensatappropriately.
there is also discussion in the reserve fund, that whilst it's the members money it is not accessible to members. and that access to it can also be dictated by the policy documents of the trustee.
