Hi Tc,
At the end of the announcement document it states that the investor "is bound by a list of trading restrictions including a cap on the market value of shares periodically traded including restrictions preventing short selling". This sounds to me like a provision set in place to prevent this type of thing. I'm not fully familiar with death spiral financing but don't you think this kind of restriction will stop it happening? I don't see how else they could execute this strategy without accumulating the stock first, precluding short-selling of course.
