Because Monash researchers made the discovery and in Australia if you are employed as a researcher your inventions are owned by your employer. ILA has licensed the patent from Monash. When you license a patent it is typical that the patent remains with the original owner and just the use rights are assigned to the licensee in return for upfront fees and royalties.
