If BHP were to bid they would surely have done so by now. This looks to be all over rover. Bidder has 44% and declared unconditional therefore bidder owns the 44%, just haven't paid for them all yet.
If a higher bid did emerge those who have already accepted won't receive the benefits of a higher bid - unless a higher bid made by the current bidder. ATM, seems a game of chess - as in most bids.
Although if BHP (or another) really do want CNR they now need to negotiate with the current bidder, who as of today have 44%.
