From memory (which has been a bit leaky the last couple of years) the agreement is technically with Mt Isa Mines, a wholly owned Australian subsidiary of Xstrata so there wouldn't be any foreign ownership problems.
My company (British Based) currently operates the same way with regards to acquisitions within Australia.
