If they have to pay an out of court settlement of which i am sure a NDA WOULD BE SIGNED then their projected cashflow would be drastically reduced and this would give them good reason to do a CR which the Doc holds all voting rights too....
Yes they can do a cr when ever they want, they just have to have good reason for doing so after stating in previous Ann's they have enough money for 12months....
The more i think about it the more it makes sense as a very clever way of extracting money from HCT's account for it to be replaced by more CR's and sh's pockets in which we have NO control
