Please correct me if I'm wrong but the court case is only to decide whether the ASX was within their power to suspend ISX and continue that suspension despite ISX compliance with questions being asked of it, it has nothing to do with the ASX findings that is a matter for ASIC. It appears to me some people think that the court will decide whether any fraud has occurred in relation to the performance shares and that is not the case.
