That would breach his statutory duty as an executive (CEO at that) of NSX.

As would:

A CEO should be getting the best deal for their company. Riddle me this: How does JK independently advise NSX shareholders of the value of the jv and and possible takeover, when not only is he an executive of ISX but also the major shareholder? JK must simultaneously get the best deal for one company at the expense of the other. It is a textbook conflict.

Not sure whether this is an ASX issue or ASIC.

Happy for someone to show me where this has happened before on the ASX and why it is not a conflict.

JK's predecessors made the decision that their best interests are in going down the isx path.

JK running the show is the best way for NSX to maximise the value in their new strategy. Pretty easy sell from where I sit.
