This sounds like very liberal use of the word "Agreement". It sounds to me like what actually happened is WKT sent a query for clarification and they recieved advice from Gov that the project would be subject to a 16% FCI via profit share.
"Not required before construction or production" - technically true, but they can't sell anything without the agreement!
