Collecting and piecing together video on the fly is not patented. What is patented is their (very clever) capability of creating a valid MPEG from disparate binaries, and streaming it over MPEG-DASH.

Video can be pieced together on the fly with standard MPEG-DASH or HLS, That's why I believe LVS and its maturity that puts them ahead -- otherwise the approach can be recreated.
