I think you pulled that quote from US Tax Law. The ATO considers a "Wash Sale" to be when the sale and re-purchase are within a short period of time. The period of time isn't actually clarified so the ATO have an amount of discretion to view different circumstances as they wish. Could be as long as 30 days but who knows.
