While it is great to see shareholders get some small recompense under civil law, by the time the three new directors were appointed it was far too late to repair the trial issues. All the then acting MD could do was stem the cash bleed, rescue what little was left from the trial results and appoint an independent expert to review the data with a view to putting a strategy, business plan and supporting financial framework with supporting delegations in place, none of which existed at the time the three new directors arrived. At the final meeting of the then board in March 2012 the evidence which had been assembled against the defendants named in the litigation update was presented and the board authorised its legal representatives to proceed to litigation that day. While it has taken two years to get a result it is good to see at least some justice under civil law.
