I thought the earnings calculation covenant would have been dealt with when the various transactions took place with BNB last year. Maybe the bankers didn't need to be involved?
Anyway, will be very interesting to see how this plays out. If banks play hard ball and push up rates too high, then perhaps LLC may take make an offer to buy the balance of 60%.
