actually if I understand it correctly, a short position does not involve ownership of the shares, merely borrowed. ("Ownership" never transfers, just a contract to "and use" those skates "
Only a share owner accrues the right to sue and that is only if they suffer damage.
So in the example by Carlos no damage to share owners (price rise) and no right or standing to sue by shorters.
But I have not looked into the law on this,it is just my best guess.
