The Shine case reads like a cut and paste of the SGH one, which was already a difficult to prove proposition based on recent precedents.
SGH was unable to find a third party litigation funder who wanted to touch this case, meaning they were fully exposed to the risks/costs if it failed.
What are the odds that they found another third-rate law firm to share the risk / reward with instead?
