With the available funds I wouldn't be anti them breaking further into the lawsuit funding as done with this case, as it increases revenue per case though as opposed to a special dividend, could be more beneficial for growth long term. Plus if it flies under the radar a little longer with fewer holders it allows more time to continue to increase the holding cheap (but I also accept what was said about differing investment horizons).
