You are missing the point imo. I think that Maccas offer to small holders might include a clause denying them legal action. Jim Brynes has confirmed this, and at a guess I'd say this guy is a fine judge of dirty rotten scoundrels and a master of rat cunning.
Chasing a few little guys means nix. They could get a contractor to do that. But a class action could be nasty. That might be why they are buying out:
a-Clients they advised
b-Subscribers to the float
These are the guys with perhaps the greatest chance of a successful action. And whether ASIC does anything or not, you can bet that any potential breaches of the corporations act will at least get a civil trial. Could be very embarrassing for ASIC if they are successful.
