Thats not necessarily true. IP related to ones still in trials perhaps do have some risk.. but they do have one marketed product in Japan and are earning royalties on it.. that royalty stream and that asset is a worthy IP as security and they also have the milestones and royalties due from their Tigenix deal for which the next ~US$6m is assured and the rest likely is much more de-risked then the other pipeline in trials which if even one has positive Phase 3 results (including the US GvHD opportunity) which already met its primary endpoint, then you have CHF, disc, RA.. there is plenty options for Hercules to feel comfortable and have decent IP as security for their loan.
