You are correct that the formulation patent is important because it provides commercial protection against formulation copycats and is not dependent on 'use', which our other patents are (common cold and COVID-19); having said that, the existing use patents do have some approved claims that give us protection that is broader just the product's use in a specific indication.
As for release 'without approval', our immediate goal is to make Nasodine available wherever we can legally and without additional approvals, e.g., without having to prove that it works as a treatment for the common cold. In the US, we believe we can do so and have launched it online as a 'nasal cleanser', with claims limited to nasal hygiene. As noted in our recent releases, Australians can buy it online from the US site (nasodine.com) and legally import it for their personal use (up to 16 bottles per order).
However, as also indicated in our recent statements, we are expecting to launch in other markets as a nasal antiseptic/disinfectant, where more robust claims can be made. Regardless, our goal is to make Nasodine available so people can use it. It is the world's first povidone-iodine nasal spray that is backed by genuine R&D, GMP manufacturing, and 6 clinical trials that have fully substantiated its safety in use.
I hope you are right that Nasodine will become a household name. At Firebrick, we all believe the product works as a treatment for the common cold if used early after symptom onset. That's why it is important to have it handy and not wait until symptoms appear - especially when you need to buy it from an overseas source, as currently is the case.
As per our recently published COVID19 Phase 2 trial, it also works to eliminate a pandemic virus (SARS-CoV-2) from the nasal passages and has previously been shown to inactivate (in vitro) all other pandemic viruses tested (yes, including avian flu). So having it commercially available in multiple locations could save lives when the next pandemic hits.
