Maybe life of mine meant the century open pit under the contract? It would be highly unprofessional or ignorant of MMG not to disclose something like a LOM contract to the new owners. MMG are s professional bunch so it must mean they believed it is terminated too.

I also highly doubt NCZ with 2 lawyers on their board would ignore such a contract if it was real and not terminated. Remember Nyrstar were in the tender process according to the release. If a contract was on foot why would you ignore it before you award contracts? NCZ must be confident to award contracts to the traders over the smelter. Clearly receiving better terms.

Either way Nystar would have to pay for the zinc concentrate so NCZ would still be making good money in this market.

Hardly a problem and simply a damages claim. If Nyrstar are successful I’m sure NCZ would be pursuing MMG for this. Not a bad position considering MMG is owed $192m for a performance bond!
