"At the end of the day the farmer or land owner cannot stop exploration on their land".

I hate to tell you this, but there is every chance that the landowner CAN stop explorers (TMG). Now, I'm not saying it's likely, and I personally lean more toward the belief that TMG will eventually gain land access—it's just a matter of when. If it ends up with the arbitration process it will be in the hands of the arbitrator to make a decision on who presents a better case, TMG or the land owner.

Notice of Intent – Explorer notifies the landowner of access plans.
Negotiate – Both parties have 28 days to agree on terms. <TMG IS HERE CURRENTLY>
Mediation – If no agreement, a mediator helps resolve issues.
Arbitration – If mediation fails, an arbitrator makes a binding decision.
Compliance – Both parties must follow the final decision.
