The 'year' seems to be any (ie rolling) 12-month period. I haven't checked the dates/amounts of the previous issue, but assume previous posters have to be commenting on this!
I agree that it seems that there may be a breach here, I can't see that any of the exceptions would apply ... if one of them does apply, then we seem to have missed out on that information anyway.
