I think Sedco will argue that they were misled about Nexus ability to pay. If they win that point, which I doubt, then they will have to prove that Nexus actually couldn't pay. Given that Nexus always had the last resort option of selling say 50% 0f Crux at a bargain price of $5 per barrel, this will be hard to prove. Given the weakness of their case, Sedco will settle (IMO) for a relatively small amount.
