NME holders stand a chance of owning 100% of the assets if they win in the Supreme Court.
That will force MCT back to the negotiating table or perhaps the animosity between the JV holders runs so deep that NME will seek a new partner.
I can't see why NME holders would accept this offer while the court case runs?
As unfair and petty as NME's case appears Contract Law is all that counts here.
NME would seem to have a case that the JV contract was breached, albeit in a minor and somewhat pathetic manner.
But when in an acrimonious relationship with NME it was reckless of MCT management to expose themselves as they probably did.
The responsibility for this is the company secretary who oversees compliance.
This is not the first stuff up that has caused the company legal grief.
