ASIC’s consideration of Flinders
As you know, ASIC considered the concerns shareholders raised with us about the
delisting and takeover applications. ASIC took steps to participate in the Takeovers
Panel proceedings and made various submissions to the Panel. ASIC provided
regular updates publicly via ASIC’s key matters page.
We have reviewed the email you sent to ASIC in December 2020 regarding Flinders.
Our team has also conducted our own confidential enquiries and consulted with our
specialist team responsible for listed companies. We weighed the obligations under
law against the evidence available and have determined that ASIC will not take
action.
