I think, the sale agreements remaining on foot refers to past they didn't complete despite remaining on foot.

This is followed by:
"Antares is currently considering its options in relation to the Purchaser's failure to complete the acquisition of the Assets under the sale agreements."

You don't consider you options until the relationship has soured.
