Found this:
"It is possible to request that acceptance (allowance) of a standard patent application be postponed and it is routine practice to do so when requesting examination. This prolongs the period during which broadening claim amendments can be made, by deferring acceptance if the Examiner has no objections. It is not possible to request that acceptance be postponed for a defined period of time. Rather, acceptance is deferred indefinitely and a positive request for withdrawal is required."
But the law was modified in 2013: http://www.fpapatents.com/resource?id=137
"Under the proposed changes, applicants will only have 12 months from the date of the first examination report to gain acceptance of their application (Figure 1). This date is not extendable. Moreover, it will now be at the discretion of the Office as to whether to grant a postponement of acceptance."
So all is not lost! There are good reasons to delay the acceptance, and in Hazer's case there may be new information coming to modify the claims.
