its not might, it is a criminal offence, but i suggested if it were to occur that the other party be aware so as to cover their arse too. Of course the only way around criminal act is if you record a conversation without consent if you are protecting yourself, say someone is trying to blackmail you and you want evidence or say if you are fear for your safety (but there is also complicated legal argument for other circumstances)
