Ok, lets put the perf share legitimacy question and demergers effective outcome for those shares to one side.
Would ASIC have an avenue to injunct the demerger on the basis ISX is leaving behind in Australia less than is required to pay fines and costs?
This is what I am so perplexed about, if I am being sued and tried to move assets/income out of the juristiction to avoid potential consequences of a claim against me, surely my opponent if aware of this would try and stop it? Surely if me doing that undermines my ability to pay a potential claim would put me in the crosshairs of some kind of an injunction?
