It seems to me that the Takeovers Panel had investigated the matter very thoroughly. I could also point out that the Takeovers Panel handed down their decision on 13 December 2019 and the decision was published on 22 January 2020. Presumably the referral to ASIC was made during that time. The Takeovers Panel were able to reach their decision in just 22 days (application received 22 November 2019) based on the material they had.

ASIC have now had the referral for at least 362 days... Either the "unacceptable circumstances" complaint has become a major criminal investigation due to overwhelming new evidence (I cant imagine what that would be) ... or it is a non-event.
