If there has been any misleading conduct, the directors become personally liable. The last 2 investor presentations and the Automic conference potentially pose significant issues for Miller if he has misled the market. Some of his statements if they cannot be backed up will expose him. Anyone lodging a claim, would quickly find out during discovery.
I don’t think the company is done just yet, but regardless there are significant questions Miller must answer. His position is untenable if the company manages to survive as is the Board’s.
