I would think that this has to be a clear positive for MEL and at the least some indication of doubt by the NSW government as to how they have handled this matter. Should the court find the government to be at fault, then a damages claim will have real legs. Keep it out of the court (which, if any of these ministers have any modicum of integrity, is what should happen) and the government can control its damage, then potentially a damages claim will be for a lesser sum.

No doubt MEL's solicitors will ask for copies of all documents relied upon by the Government to make this "new" determination.
