I dont think that you can avoid the fidiciary duty you have and primary to that must be protection of assets.
I am not unsympathetic to the difficulty they had but must also ask the question as to how much due diligence was done when it became clear that Sargon could not float its IPO nor get its convertible note funded. We are talking about 60 days odd from that.

What do you do when you're selling a buisness and a buyer comes along. Refuse to sell to them because of past transactional issues?

Let's hope that OVH have covered themselves. They do have some experience with acquisitions. They might still end up on top here.
