You correct, at that time they didn't hold the exploration licences but they did hold the exploration licences when they made the 2018 announcement (they had all leases to operate).
The Waturta were successful with their claim in 2018 (from memory) and APC still hasn't reached an agreement. We know from the EPA ERD that they have tried to negotiate. Are APC now making their application for leases so they end up in the NNTT and can attempt to argue that they have negotiated in good faith but the Waturta haven't? Events at both RWD & SO4 (both went to the NNTT) tell us that the NT party is likely to win.
Organic certification means FA without a NT agreement.
