what about the ones they have already sold? Wasn't that the reason for the litigation???
That would have been a lump sum settlement. It sounds like they have come to a royalty arrangement.
If there is a good sales pipeline with Avitar, this is probably the best course of action as otherwise it could alienate them if they pushed for settlement.
